Currently Sharing or Thinking of Sharing?

Western Carolina University takes great lengths to protect the intellectual property rights of it’s student, faculty, and staff.  In return, we expect our students, faculty, and staff to respect and protect the intellectual property rights of others.  Unfortunately, there is a very large number from all facets of the campus community in violation of these laws and we receive enough infringement notices each year equivalent to one for each day.

Most commonly seen P2P or other file sharing applications seen on the WCU Campus:

BitTorrent
FrostWire
uTorrent
Azureus
Bearshare (before v. 9)
MP3 Rocket

There are many other types of file sharing applications, these are just the most commonly seen ones on this campus.

What Happens if I Get Caught on Campus?

Upon notice from a copyright holder or on behalf of a copyright holder:

Faculty & Staff:

First Offense:

  1. Internet is disconnected – computer or wireless credentials are moved into a subnet that allows only access to campus sites.
  2. The infringing party’s supervisor (or Dean) and Human Resources will be notified via email.   The email will state the particular infringed material, the employee’s name responsible for the infringement, and the steps to take to ensure that the infringing material is removed along with suggestions or information on how the employee can obtain help in removing any applications that were used in the infringement.
  3. Upon acknowledgement of the notice by the supervisor or Dean, Internet will be restored.

Further Offense:

  1. Internet is disconnected – computer or wireless credentials are moved into a subnet that allows only access to campus sites.
  2. The infringing party’s supervisor (or Dean) and Human Resources will be notified via email.   The email will state the particular infringed material, the employee’s name responsible for the infringement, and the steps to take to ensure that the infringing material is removed along with suggestions or information on how the employee can obtain help in removing any applications that were used in the infringement.
  3. Upon acknowledgement of the notice by the supervisor or Dean, Internet will be restored or any further requests per the supervisor or Human Resources.
  4. Any further disciplinary action deemed appropriate by the supervisor and/or Human Resources.

Student:

 First Offense:

  1. Loss of Internet connection. (LAN or Wireless or both)
  2. Online “Responsible Computing Course” with passing grade of 85% or higher to have Internet reinstated.
  3. Monetary Educational Assessment Fee.
  4. Other sanctions deemed necessary by the Department of Student Community Ethics.

Second Offense:

  1. Loss of Internet connection (LAN or Wireless or both) for 3 months from the date the case is settled with the Department of Student Community Ethics.
  2. Monetary Educational Assessment Fee.
  3. Other sanctions deemed necessary by the Department of Student Community Ethics.

Third Offense:

  1. Loss of Internet connection (LAN or Wireless or both) for one (1) semester from the date the case is settled with the Department of Student Community Ethics.
  2. Monetary Educational Assessment Fee.
  3. Other sanctions deemed necessary by the Department of Student Community Ethics.

Fourth Offense:

  1. Loss of Internet connection (LAN or Wireless or both) for one (1) year from the date the case is settled with the Department of Student Community Ethics.
  2. Monetary Educational Assessment Fee.
  3. Other sanctions deemed necessary by the Department of Student Community Ethics.
